Former President Goodluck Ebele Jonathan had inaugurated the newly built multi-million naira Delta State High Court complex in Asaba, the state capital.

The project started during former Governor James Ibori but the building collapsed midway due to structural defects and it was abandoned.

His successor, Dr Emmanuel Uduaghan who struggled to complete the project could not, until eight years elapsed.

The immediate past Governor Ifeanyi Okowa, who demolished, redesigned and built it afresh to withstand global standard could not also complete it before he left office.

His successor, Elder Sheriff Oborevwori, who fully underscored and acknowledged the importance of the huge symbol of justice, completed it within one year in office.

But in ground style in Asaba Jonathan, the universally celebrated national icon of peace and leadership integrity, who commissioned the complex, urged the users to observe maintenance culture.

He said it was worthy of note that the Governor kicked-started his second year in office with commissioning of legacy projects.

The Governor said the magnificent, five-storey edifice, adorned with six conference halls, six witness waiting rooms, six secretary offices, six courtrooms, six holding cells, Lawyers Lounge, Judges Lounge and VIP Lounge.

With Multi-purpose Hall, General Conference Hall, Ceremonial Hall, Chambers, a library, zoom room, computer laboratory, public and private elevators, registry, canteen, car park and male and female convenience apartments, a 350 KVA Generator and paid independent power plant connected to the State Independent Power Plant, would serve as “the citadel of hope and bastion of justice for years to come.”

He promised to continue to work relentlessly to advance and transform the state with his M.O.R.E Agenda for more dividends of democracy.

TINUBU ORDERS CBN TO SUSPEND IMPLEMENTATION OF CYBER SECURITY LEVY

President Bola Tinubu has asked the Central Bank of Nigeria to suspend the implementation of the controversial cybersecurity levy policy and ordered a review.

This followed the decision of the House of Representatives, which, last Thursday, asked the CBN to withdraw its circular directing all banks to commence charging a 0.5 per cent cybersecurity levy on all electronic transactions in the country.

The CBN on May 6, 2024, issued a circular mandating all banks, mobile money operators, and payment service providers to implement a new cybersecurity levy, following the provisions laid out in the Cybercrime (Prohibition, Prevention, etc) (Amendment) Act 2024.
According to the Act, a levy amounting to 0.5 per cent of the value of all electronic transactions will be collected and remitted to the National Cybersecurity Fund, overseen by the Office of the National Security Adviser.

Financial institutions are required to apply the levy at the point of electronic transfer origination.

The deducted amount is to be explicitly noted in customer accounts under the descriptor “Cybersecurity Levy” and remitted by the financial institution. All financial institutions are required to start implementing the levy within two weeks from the issuance of the circular.

By implication, the deduction of the levy by financial institutions should commence on May 20, 2024.
However, financial institutions are to make their remittances in bulk to the NCF account domiciled at the CBN by the fifth business day of every subsequent month.
The circular also stipulates a timeframe for financial institutions to reconfigure their systems to ensure complete and timely submission of remittance files to the Nigeria Interbank Settlement Systems Plc as follows: “Commercial, Merchant, Non-Interest, and Payment Service Banks – Within four weeks of the issuance of the Circular.
“All other Financial Institutions (Microfinance Banks, Primary Mortgage Banks, Development Financial Institutions) – Within eight weeks of the issuance of the Circular,” the circular noted.

The CBN has emphasized strict adherence to this mandate, warning that any financial institution that fails to comply with the provisions will face severe penalties. As outlined in the Act, non-compliant entities are subject to a minimum fine of two per cent of their annual turnover upon conviction.

The circular provides a list of transactions currently deemed eligible for exemption, to avoid multiple applications of the levy.
These are loan disbursements and repayments, salary payments, intra-account transfers within the same bank or between different banks for the same customer, and intra-bank transfers between customers of the same bank.

Exemptions include other financial institutions’ transfers to their correspondent banks, interbank placements, banks’ transfers to CBN and vice versa, inter-branch transfers within a bank, cheque clearing and settlements, letters of credit, and banks’ recapitalisation-related funding.

Others are bulk funds movement from collection accounts, savings, and deposits including transactions involving long-term investments such as treasury bills, bonds, and commercial papers, and government social welfare programmes transactions.
These may include pension payments, non-profit and charitable transactions including donations to registered non-profit organizations or charities, educational institutions transactions, including tuition payments and other transactions involving schools, universities, or other educational institutions, and transactions involving the bank’s internal accounts, inter-branch accounts, reserve accounts, nostro and vostro accounts, and escrow accounts.

The introduction of the new levy sparked varied reactions among stakeholders as it is expected to raise the cost of conducting business in Nigeria and could potentially hinder the growth of digital transaction adoption.

Members of the House of Representatives on Thursday asked the Central Bank of Nigeria to withdraw the circular directing financial institutions to commence implementation of the 0.5 per cent cybersecurity levy, describing it as “ambiguous”.
The development was in response to a motion on the urgent need to halt and modify the implementation of the cybersecurity levy, moved by Kingsley Chinda.

According to the House, the CBN is to withdraw the initial circular, and “issue a more understandable one”.
Chinda had drawn the attention of the House to multiple interpretations of the CBN directive against the specifications in the Cybersecurity Act.

The House then expressed worry, that the Act would be implemented in error if immediate steps were not taken, to address the concerns around the interpretation of the CBN directive and the Cybersecurity Act.

Police Take Over Rivers House Of Assembly Quarters Rivers Assembly

ur medium gathered that About 30 armed policemen have taken over all the entrances to the House of Assembly quarters located along the Aba Road, Port Harcourt, Rivers state.

It was gathered that both the first and second gates to the lawmakers’ estate were safeguarded by the police with about 30 patrol vans used to block the entrances.

The development came shortly after the Martins Amaewhule-led House of Assembly claimed that the governor was planning to demolish the quarters following his recent surprise visit to the facility.

But the governor, Siminalayi Fubara, had explained that his visit to the estate on Thursday was harmless.

The governor said: “Is the Assembly quarters not part of my property? Is there anything wrong in going to check how things are going on there?

“You are aware of the developments. We have a new speaker, and I went there to see for myself how things are. There might be a few things I might want to do there for the good of our people.”

It was learnt that following the alarm raised by Amaewhule, the anti-Fubara lawmakers including some chieftains of the All Progressives Congress (APC) kept vigil around the estate till daybreak.

Armed policemen were seen barricading the gates on Friday to secure the facility.

However, the Sim Media Volunteers (SMV) called on the Inspector-General of Police (IGP) to monitor the activities of policemen in the state and ensure they observed the rules of engagement.

The convener of the group, Frank Kilsi, decried the arrest and intimidation of the governor’s supporters by the police saying the development could lead to anarchy.

Kilsi, who spoke in Port Harcourt, on Friday, said: “We call on the Inspector-General of Police to rein in his men and exercise restrain by stopping the unnecessary attack or wanton arrest on any of the governor’s supporters, as further harassment could lead to anarchy and breakdown of law and order that may not do our state any good.

Kilsi appreciated the overwhelming support of Rivers people to Fubara and their decision to stand firm in defence of democracy despite challenges.

He said: “We, the youths of the state, under the aegis of SIM Media Volunteers, do hereby emphasize the need for peace, justice and development in Rivers State.

“We implore all relevant stakeholders such as the citizens, political leaders, traditional institutions, and law enforcement agencies, to ensure that the rights and freedom of the people are upheld and protected at all times.

“To this end, we would like to acknowledge and applaud the great youths of Rivers State for being peaceful and law-abiding even in the face of provocation”.

Kilsi commended the governor’s peaceful disposition and commitment to the security of lives and property in the state and asked him to continue on such a path of development.

He said Fubara’s commitment to the advancement of the state had opened up the space and the state for investors.

He said: “This is clearly justified by the forthcoming Rivers State Economic and Investment Summit slated as part of the first anniversary of His Excellency.

“It is obvious that detractors may not acknowledge this bold step that has eluded the state in the past, but with cutting-edge leadership imbued in fortified strategic procedures, our state is about to witness another season of economic prosperity.

“It is on this note that we want to address the sore losers of the inglorious October 30, 2023 impeachment plot against the governor to stop their callous, mischievous, and barefaced sabotage and evil against the governor and his government.

“We urge them to desist from every act of thuggery, banditry, and violence as well as subtle connivance with the police to harass, intimidate, arrest and incarcerate followers and supporters of Governor Fubara”.

Kilsi applauded the sterling leadership of Fubara commending his efforts to improve the state’s Internally Generated Revenue (IGR) from N12bn to N27bn within a year of his administration.

Describing the feat as unprecedented, Kilsi said it had singled him out amongst his contemporaries as he highlighted other developmental successes in human capital development, quality Infrastructure delivery, provision of the functional healthcare system, revamping of the educational sector, job creation, security and welfare of citizens.

“These remarkable achievements reflect Governor Fubara’s acumen and steadfast dedication to prudent fiscal management of resources, ensuring equitable and sustainable development of the state.

“We further seize this opportunity to commend the President, Bola Ahmed Tinubu for his painstaking efforts at actualising the renewed hope agenda for the nation”.

CIVIL RIGHTS COUNCIL OF NIGERIA CALLS ON IGP TO INVESTIGATE OTERI SHOOTING

Civil Rights Council of Nigeria, Asaba unit headed by Comrade Joy Edigbine, has urged the Inspector General of Police (IGP) to caution officers at the Ughelli Area Command in Delta State, Nigeria.

Edigbine, who coordinates the Asaba unit of the Civil Rights Council of Nigeria and heads the JEEP Film Academy, emphasized the need for the Nigeria Police Force and the IGP to rein in officers stationed at the Ughelli Area Command.

During a discussion with members of the press, Edigbine condemned the unjustified attacks on women from the Oteri community who were protesting against alleged misconduct by the police in the command.

She stressed that such actions contradicted the ethical standards expected of the Nigeria Police, whose duty is to safeguard the lives and property of the community.

Additionally, Edigbine called for a thorough investigation into the reported attacks on peaceful Oteri community protesters, demanding that those responsible be held accountable to deter similar incidents in the future.

She asserted that no law sanctioned the use of force against the women of Oteri community, who were peacefully demonstrating against alleged corruption within the command.

According to Edigbine, several women, including Miss Valentine Adomi, Mama Harvest Ugbuwiako, Edith Itive, Akaeze Joy, Loveth Brown-Tate, and Mrs. Lucky Philip, sustained critical injuries and were receiving treatment at Central Hospital Ughelli after allegedly being fired upon by policemen attached to the Ughelli Area Command.

Edigbine disclosed that the women were expressing their grievances on their way to the palace before the incident occurred.

“We cannot allow this injustice to persist. We refuse to live in fear due to the actions of policemen who are meant to protect us and our properties,” she declared.

SEVEN WOMEN CRITICALLY INJURED AS POLICE OPEN FIRE ON UGHELLI WOMEN

A nursing mother and six other women of Oteri community in Ughelli North Local Government Area of Delta State that protested against police extortion were yesterday shot at and rushed to the hospital for survival.

The women allegedly took to the streets after their children, whom they claimed were on errands, were arrested and detained, and N150,000 and N200,000 respectively were collected to bail each of them.

The President-General of the community, Mr Efe Erakpofoke-Peter, who condemned the action of the trigger-happy policemen that shot at the protesting women, said the extortion had become an incessant harassment from the policemen attached to Ughelli Area Command.

The leaders of the women, Madam Harvest Ugbhwiako and Mrs. Vivian Aphiare, in their separate remarks said it was a peaceful protest but on arrival at the gate of the Area Command, they were rebuffed, attacked, tear-gassed and shot at by the men of the command.

They said they staged the protest, following the extortion and bribes being collected from their children who are commercial motorcycle and tricycle riders.

“Because of police extortion, once it is 8p.m, you cannot get motorcycles or tricycles to carry you to where you are going. Old men and women will have to trek long distances from the Ughelli main market every day because of police harassment.T

“Thisresulted to many of us sustaining various degrees of injuries and they were rushed to the hospital for treatment. Prior to this, we were in a peaceful protest to the Palace of Ovie of Ughelli kingdom to register our grievances”, Ugbhwiako said.

She said this happened after the Area Commander called to appeal to the women to go home and their complaints would be addressed.

“But before we pass the message round, what we heard next was that police habe started shooting and tear-gassing the protesters, leaving many with injuries”, the President-General lamented.

He said the women have no other choice than to protest against the random raid of their sons for which they paid N200,000 to bail each of them.

“Recently the police embarked on random arrest and ransacking of houses, belonging to the youths of the community and carted away their personal belongings, and detained so many of them.

“Our community is peaceful and law-abiding. Police should stop making life difficult for us. They are making life difficult for the poor and innocent citizens in Oteri.h

But the Ughelli Area Commander, ACP Adebayo said his office was already looking into the complaints from the community with a view to sanctioning any police officer found wanting.

He said he had since disbanded the squad of hunters, operating mischievously under the command

DELTA LG POLL: DELTA APC DECLARES WAR OVER DSIEC CONSTITUTIONAL BREACHES

The All Progressives Congress in Delta State has given the Independent Electoral Commission (DSIEC) in the state a seven day ultimatum to address the gross violation of Section 32(1)-(3) in its 2017 law to avoid legal fireworks.

The party handed down the warning in a petition dated, Monday, May 6, 2024, addressed to the Chairman of the commission, Chief Agbaike.

The controversial Section stipulated that the commission shall issue the notice of election not earlier than 150 days before, and not later than 30 days, before the expiration of the term of the last holder of the office, which has been allegedly violated.

APC Acting Secretary in the state, Ogbueshi Anselm Onianwa, said the error calls into question the very legality and legitimacy of the whole electoral exercise ab-initio.

He maintained that the commission must take cognizance of this mandatory provisions of strict compliance that cannot be trifled with, insisting on a serious case of dereliction of duty.

He said the breaches are inimical to the very core of the commission as an independent body saddled with such enormous responsibility and it leaves little room to doubt that the whole exercise is a charade, designed and skewed in favour of a certain political party.

He said, “the commission has woefully failed to inspire confidence as an unbiased umpire capable of conducting free and fair elections that meet the barest minimum standards.

“Going by the notice of the dates, 6th to 26th May, 2024, fixed for political parties to conduct their primaries to nominate candidates clearly contravene the provisions of Section 97, which mandatorily requires political parties to give the commission a 21-day notice of the conduct of such primaries.”

He lamented that the failure had cut out political parties of time to issue the commission with the requisite notices.

He said consequently, any primary conducted in such a situation, remains a nullity, having ran foul of the commission’s Law 2017.

He urged commission to take urgent steps to address the constitutional breaches that may rob the process of any form of validity, sanctity and integrity.

“Consequently, we are by this vehement protest giving your commission 7-days notice within which to correct these legal aberrations, failure to do so shall result in an action in a court of law for redress”, the petition read.

CIVIL RIGHTS COUNCIL MEETS PENSION BOARD BUREAU **** Advocate For Prompt Payment Of Gratuity, Pension

Civil Rights Council of Nigeria Asaba Unit has advocated for prompt payment of gratuity and pension of Delta State retired civil servants in the State

The council who made the advocacy during an interactive session with the Bureau for Pension Board in Asaba, after receiving several complaints especially from Mrs. Cecilia Okoh, who had retired as Headmistress of Odili Primary school, Agbor, Delta State of Nigeria, disclosed the it was necessary for the bureau to expedite prompt payments of gratuity and pension of retirees in the State

Speaking during the interactive session, the Council Asaba Unit coordinator, Comrade Joy Edigbine emphasized prompt payments of gratuity, and pension, revealing it was a veritable means of helping mitigate the economic downturn of the retirees

Comrade Joy Edigbine disclosed that it was necessary to get clarity from the board why there were obvious delays in payments of gratuities of those who had meritoriously served the state in different capacities.

She noted that the retirees were mainly old people who had served the State at different fronts, many of whom needed money to take care of their health.

The Delta born activist who doubles as the Chief Executive Officer of Jeep Film Academy, maintained that it was the rights of the retirees to get their gratuities since there was no other means of getting live sustenances and pay their bills

Her words,” we are here to get clarity from the board on several complaints from our retired civil servants that have served the state and have not been paid their gratuities.”

Reacting to the claims of the Civil Rights Council of Nigeria, the Bureau claimed that the delay in payments were as result of late documentation of some retirees, as well as limited fund disbursements by the Delta State government.

 

His words,” Many of the retirees, would not document early which would affect early payment. And another one is, the limited funds released by the State government. These are our challenges.”

 

The Bureau further claimed that retirees were going to meet some Staffers to lobby the system, disclosing that it was a major challenge mitigating payment and procedures of payments

Adding further, Comrade Joy Edigbine eulogized the board for finding time to listen to the council and clarified issues, just as she urged the Bureau to educate their Staffers to decease from any act that can further affect the effectiveness of their operations.
